Complimentary Trademark Survey and Identical Mark Search

Trademarks protect words, names, symbols, sounds, or colors that distinguish goods and services from those manufactured or sold by others and to indicate the source of the goods. Trademarks, unlike patents or copyrights, can be renewed forever as long as they are being used in commerce. “Trademark” refers generally to the four types of marks that can be registered with the USPTO: trademarks, service marks, certification marks, and collective marks. Since registration confers essentially the same benefits for all types of marks, the term “trademark” is often used to generally apply to trademarks, service marks, certification marks, and collective marks.

Nyman IP offers a complimentary trademark survey and identical mark search. With this service, we will review your website, product listings, and other materials to identify branding that is potentially eligible for trademark protection. We also perform a cursory search for identical marks using U.S. Patent and Trademark Office databases to help a potential applicant determine the best course of action to protect its brands.

Nyman IP also offers a comprehensive trademark search and opinion using fixed fee pricing.  Please contact us if you wish to discuss this service in more detail.

Complimentary trademark survey and identical mark search

Fee: $0

Please note that this service covers only the activities listed below.
- Review of website, product listings, and other materials to identify branding that is potentially eligible for trademark protection.

- Cursory search for identical marks using U.S. Patent and Trademark Office databases.

- Preparation of letter summarizing review and results of cursory search.

The above service will not include any legal opinion and will not establish a representative relationship between the requesting party and Nyman IP. Before any legal service can begin, Nyman IP must conduct a conflict check to ensure all parties can work together. Additionally, a representation agreement must be signed and accepted before representation can begin or any services are performed.

We at Nyman IP would love to help you protect your brands, but we must formally establish our relationship with you before we can do so. Similar to a consultation, this survey and identical mark search is intended to help a requesting party decide if it makes sense to begin legal representation.

Why is it important?

Trademark registration and maintenance is complex. Although not required, most owners use private trademark attorneys for legal advice regarding use of their trademark, registration of a mark, and the unique issues for maintaining a federal registration, since not all registration remain valid perpetually. A private trademark law firm (not associated with the USPTO), such as Nyman IP, may help you avoid many potential pitfalls.
